A group of Warwood residents sued Silicon Foundation on July 22, 2026, in Ohio County Circuit Court, seeking to stop a data center and energy technology campus the company plans for the former Centre Foundry & Machine Company site on W.Va. 2. Silicon Foundry Energy LLC, doing business as Silicon Foundation, bought the 15-acre property for $1.5 million; the company's chief energy and infrastructure officer, Andrii Garanin, has said its first project there is manufacturing modular components for data centers, with a possible computing campus to follow. City and state officials say the site will stay under the 90-megawatt threshold that would make it a "high-impact" data center.

The residents' suit argues that House Bill 2014, the 2025 state law regulating high-impact data centers, is unconstitutional. West Virginia Attorney General J.B. McCuskey intervened to defend the law, writing that any constitutional injury is "purely speculative" because "the Warwood Data Center has not yet been constructed." Ohio County Circuit Judge David Sims granted the state's motion to intervene in mid-August. "There's a lot of things we don't know about data centers," resident Polly Barks, one of the plaintiffs, said at an earlier town hall.

Wheeling City Council was scheduled to vote September 15, 2026 on a memorandum of understanding committing Silicon Foundry Energy to stay under the high-impact threshold; the plaintiffs' attorney, J. Anthony Edmond Jr., urged the council to pass a moratorium ordinance instead, arguing the MOU's timing gave the public no real chance to weigh in. The vote was scheduled for that date; no result has been published.
