Amazon's Birchwood project covers 869 acres at the site of the former Birchwood Power Facility, north of the Rappahannock River on the east side of Fredericksburg, in King George County. Amazon told Virginia officials it planned to invest up to $6 billion in 17 data centers there, according to a report on the resulting court case.

On December 19, 2023, the King George Board of Supervisors approved a performance agreement and zoning changes clearing the way for the project. Amazon says it then bought the property for almost $169 million and spent $6 million advancing the project. A newly elected board majority took office and rescinded that agreement at its first meeting, on January 2, 2024. Supervisor Cathy Binder, who had voted for the rezoning despite concerns about the company's control of a water intake on the Rappahannock, asked the new board to reconsider it. Amazon sued the county in circuit court in May 2024, arguing it had vested property rights under the approved rezoning and that the county's zoning administrator had missed a legal deadline to certify those rights. Curry Roberts, the retired president of the Fredericksburg Regional Alliance, asked: "What company is going to build in a county that doesn't honor an approved performance agreement?" Judge J. Bruce Strickland ordered limited discovery in the case in January 2026. King George has tried to use a new state law, in effect since July 1, 2026, to limit what Amazon can obtain in discovery; Amazon argues the law should not apply retroactively. A trial was scheduled for September 2026, after an earlier date in May 2026 was pushed back.
