More than a dozen Kentucky local governments, including Louisville and Lexington, have paused new data centers while they write rules. Louisville Metro Council voted 24-1 on August 13, 2026 for a six-month moratorium, days after Dermody Properties proposed turning a 350,000-square-foot warehouse on Kramers Lane in southwest Louisville into a data center; a large data center is already under construction on Camp Ground Road. The city's draft rules would ban data centers larger than half a million square feet in Jefferson County and still need Metro Council approval.

In Mercer County, the Fiscal Court unanimously passed a one-year moratorium in unincorporated areas on August 11, but the small city of Burgin is weighing annexing the farmland where Panattoni Data Centers proposes its "Project Bluegrass," which would take it out of county zoning. Burgin has no planning and zoning rules that could limit a data center. In Boyd County, a six-month moratorium passed July 9 exempts the TeraWulf data center planned at the EastPark industrial park off I-64.

Opposition has also shown up at the ballot box. Oldham County became the first in Kentucky to block a project in 2025, when a fight over a $6 billion data center on farmland ended in a moratorium and the company walking away; in the May 2026 primary, opposition leader Rob Houchens won the Republican nomination for judge-executive. "I felt like we were fighting against the people that were supposed to be representing us," he said. In Simpson County, Judge-Executive Mason Barnes, whose county is being sued over its land-use ordinance by the developer of a proposed $5 billion data center, also won his primary.

A state bill to make large data centers pay for the grid upgrades built for them passed the House 90-8 but was stripped out on the last day of the 2026 session. Lexington's moratorium runs through October 31 while its planning commission writes data center rules.
