Texas has halted state approvals for new data centers. On September 21 Gov. Greg Abbott ordered the Texas Commission on Environmental Quality to issue no permits for data center projects until state audits of their power and water use are done, widening the freeze on new grid connections he ordered August 3. "Simply put, Texans must come first," Abbott wrote. The biggest projects under construction include Fermi America's HyperGrid in Carson County, IREN's campus at Sweetwater and SB Energy's sites in Milam County.
The audits ask developers for their electricity and water use, tax breaks, ownership and plans to limit harm to neighbors. Only about 28% of data centers answered a state water-use survey, and on September 14 Abbott told the Texas Water Development Board to penalize those that do not report. Counties have little power of their own: Hood County dropped a moratorium after state Sen. Paul Bettencourt said it had no legal authority, and Hill County rescinded one after a developer sued for $100 million.
Cities are acting too. San Marcos became the first Texas city to ban data centers, voting 4-3 on June 16 to make them ineligible anywhere in the city; Bettencourt says he will challenge the ban. Fort Worth's council voted unanimously in August to start a 90-day moratorium, which under state law needs public hearings first. The first hearing is set for November 10, and the pause would begin February 16, 2027.
